Biozidrechts-Durchführungsverordnung: Alle Infos zu der neuen Regelung

Seit dem 01.01.2025 regelt die Biozidrechts-Durchführungsverordnung (ChemBiozidDV) den Verkauf von bestimmten biozidhaltigen Produkten wie Antifoulings, um Mensch und Umwelt besser zu schützen. Die wichtigsten Infos zu den Neuregelungen haben wir hier für Sie zusammengestellt.

Was ist die ChemBiozidDV?

Die Biozidrechts-Durchführungsverordnung (kurz: ChemBiozidDV) ist eine Verordnung, die 2021 in Kraft getreten ist. Sie regelt die Zulassung und den Verkauf bestimmter biozidhaltige Produkte wie Antifoulings.

Die Paragraphen § 9-13 der Verordnung gelten erst seit diesem Jahr, sie beinhalten eine strengere Regelungen für die Abgabe und dem Verkauf bestimmter biozidhaltiger Produkte.
Ziel der Verordnung ist es, durch diese Regelungen die unkontrollierte Verwendung und Freisetzung schädlicher Stoffe in die Umwelt zu minimieren und damit Mensch und Umwelt besser zu schützen.

Biozide in Antifoulings - warum sie gefährlich sind

Biozide sind in vielen Bereichen unseres alltäglichen Lebens vorhanden: sie kommen in Reinigern, Pflanzenschutzmitteln, Desinfektionsmitteln oder in Schutzanstrichen wie Holz- und Antifoulingfarben vor. Aber was steckt eigentlich hinter diesem Begriff?

Als Biozide bezeichnet werden chemische Stoffe und Gemische, die entwickelt wurden, um unerwünschte Organismen wie Bakterien, Pilze, Insekten, Algen oder Nagetiere zu bekämpfen. In Antifouling-Farben werden sie eingesetzt, um unerwünschten Bewuchs zu bekämpfen, da Algen und Muscheln nicht nur die Fahrtgeschwindigkeit beeinträchtigen, sondern auch Schaden am Rumpf oder Antrieb verursachen können.

Das Problem bei der Verwendung von biozidhaltigen Antifoulings ist, dass sie nicht nur die Zielorganismen wie Algen und Muscheln abtöten, sondern auch andere Lebewesen in den Gewässern schädigen können. Viele Biozide sind zudem schwer abbaubar (persistent) und reichern sich im Wasser und im Boden an. Dies kann langfristig zu Schäden an den Ökosystemen und möglicherweise auch für die menschliche Gesundheit führen.

Wie ändert sich der Verkauf biozidhaltiger Antifoulings bei TOPLICHT?

  • Seit dem 1. Januar 2025 gilt für den Verkauf biozidhaltiger Antifouling- Farben an PrivatkundInnen ein Selbstbedienungsverbot. Das bedeutet, dass die betroffenen Produkte in unserem Ladengeschäft nicht mehr frei zugänglich stehen, sondern verschlossen aufbewahrt werden und auf Nachfrage herausgegeben werden.
  • PrivatkundInnen werden zusätzlich vor Kaufabschluss in einem verpflichtenden Beratungsgespräch durch unsere geschulten Sachkunde- MitarbeiterInnen über die sichere Anwendung und umweltschonende Nutzung informiert.

Was ist die ChemBiozidDV?

  • Bisher betrifft die Verordnung im TOPLICHT-Sortiment nur biozidhaltige Antifoulingfarben.

Alternativen: Benötige ich ein biozidhaltiges Antifouling?

HEMPEL HEMPASPEED TF Thin-Film Bottom Coating
HEMPEL'S Hempaspeed TF is a hard, biocide-free thin-layer coating for all sports boats with GRP, steel or aluminum hulls, including regatta and trailer boats. Thanks to the special hydrogel technology, it forms an ultra-smooth surface that minimizes fouling and also reduces friction. Suitable for fresh, salt and brackish water as well as inland areas. Particularly recommended in areas where the use of biocides is prohibited or restricted (also in the Netherlands). Application on existing antifouling layer: It is possible to switch from a conventional antifouling to Hempaspeed TF. The old coating (if still intact) does not need to be removed. LeFANT T-COAT is a biocide-free coating for underwater hulls based on epoxy resin. It forms a hard, smooth surface that makes it difficult for growth such as algae to adhere and also protects the hull from moisture penetration. LeFANT T-COAT is free of silicones and metals and is suitable for all waters. Regionale Vorschriften beachten

Es gibt Gewässer, in denen die Verwendung biozidhaltiger Antifoulings eingeschränkt ist. Informieren Sie sich über die örtlichen Verbote und Einschränkungen. Diese können Sie meist bei regionalen Verbänden, Segelclubs oder dem ansässigen Hafen erfragen.

Verkehrsfähigkeit prüfen

Achten Sie beim Kauf eines biozidhaltigen Antifoulings darauf, dass es gemeldet bzw. zugelassen UND verkehrsfähig ist. Auf dem Etikett können Sie feststellen, ob das Produkt eine Registriernummer (z.B. N-12345) oder die Zulassungsnummer (z.B. DE-00123145-21) besitzt. Ob das Produkt verkehrsfähig ist, lässt sich in der Datenbank der gemeldeten Biozidprodukte und in der Datenbank der zugelassenen Biozidprodukte überprüfen.

Verarbeitunghinweise beachten

Beachten Sie die Verarbeitungshinweise sowie Sicherheitsmaßnahmen des Herstellers bei der Verwendung des Antifoulings. Diese Angaben finden Sie auf dem Etikett oder im Technischen Datenblatt, welches wir für jedes Produkt als Download bereitstellen.

Schützen Sie die Umwelt

Treffen Sie vor der Verarbeitung biozidhaltiger Antifoulings entsprechende Maßnahmen, um die unkontrollierte Freisetzung in die Umwelt zu vermeiden:
  • Abwasser aus Reinigungsarbeiten sollte nicht ungeklärt entsorgt werden
  • entfernter Bewuchs und Beschichtungsreste gehören in den Abfall, keinesfalls in die Natur
  • Reinigen Sie den Rumpf nicht auf unbefestigten Waschplätzen, die Abwasser nicht auffangen

Lagerung und Entsorgung:

  • Lagern Sie Antifoulings luftdicht verschlossen, außerhalb direkter Sonneneinstrahlung bei Temperaturen zwischen 5 und 25 Grad.
  • Bewahren Sie Antifouling-Dosen außerhalb der Reichweite von Kindern auf
  • Farbreste und leere Dosen nicht in den Restmüll, sondern beim Recyclinghof entsorgen.
Das Bundesamt für Umwelt hat hierzu einen Leitfaden für Antifoulings veröffentlicht, in dem wichtige Informationen über die rechtlichen Rahmendbedingungen beim Umgang mit biozidhaltigen Antifouling-Produkten enthalten sind.
